Ginny Gorman, Realtor in RI that Knows the Probate Process

The probate process for home sellers is very defined by the rule of law and for home sellers to follow.  If a family member is unsure of who to contact regarding the RI probate process, please reach out to me, Ginny Gorman,  My job as a Realtor of choice in the RI real estate landscape is to guide you well through the probate process.

Probate Process

Once you, the potential seller,  meet with the attorney to handle the probate process the attorney will go to court.  The purpose is to have an executor (executrix) named so you can proceed with the home sale.  In addition, the court defines who will manage  the estate and how assets are distributed.  Even if a will is in hand, the attorney must go in front of the court with the will.  Probate can only be avoided for a home sale when a Trust or when rights of survivorship on a home are in place.  This is valuable information to know if your family is wondering how to protect ones assets from public viewing.

Price the Property Right

The RI probate court will require a written appraisal of the property.  Ensure you talk to the Realtor so the appraiser hired is one who is familiar well with the town and the home values.  Hire an appraiser who is well versed with the area.  If there is disagreement with the appraisal value talk with your attorney and Realtor.  Deferred maintenance on the home, flood zone issues, environmental issues all play a part in pricing a property correctly.  Other points to consider include whether to sell the house As Is or to do some deferred maintenance to increase the selling price on the home.  Ensuring the removal of the contents of a property is necessary prior to putting the home on the market with the real estate agent.  Ginny Gorman can refer a number of company’s to you for clean outs as well.  It is extremely important that a Realtor in RI that has experience in the probate process is hired.

Selling the Property

Depend on your Realtor to set up the pictures to showcase the property and move forward with listing the property for probate sale.  Disclosures for a probate sale are not required but a signed listing agreement is needed.  Once an accepted offer is received by the Executor it must be provided to the attorney.  The attorney will present it to the probate court for approval and if accepted the sale will move forward.
